Dual Nationality & Renunciation Guidance

Professional Legal Advice on Acquiring or Renouncing Citizenship

Understand your rights and obligations with expert support from Legate Hub — precise, confidential advice for dual nationals and renouncing citizens.

Overview

Dual nationality allows a person to hold citizenship of more than one country simultaneously. While the United Kingdom permits dual nationality, not all countries do. Legate Hub provides expert legal assistance to evaluate the impact of acquiring or renouncing citizenship, addressing immigration, taxation, military service, property, and family law implications.

Country-Specific Notes

  • South Africa 🇿🇦: Citizens must apply for retention of South African citizenship before voluntarily acquiring another nationality. Failure to do so results in automatic loss of South African citizenship under Section 6(1) of the Citizenship Act 88 of 1995.
  • Nigeria 🇳🇬: Dual nationality is permitted for citizens by birth. Nigerians by registration or naturalisation generally lose Nigerian nationality if they acquire another citizenship voluntarily without presidential approval.
  • India 🇮🇳: India does not permit dual citizenship. Acquiring foreign citizenship automatically results in loss of Indian nationality under Section 9 of the Citizenship Act 1955. An Overseas Citizen of India (OCI) card may be an alternative.
  • Pakistan 🇵🇰: Dual nationality is allowed only with certain countries (including the UK). Check the Ministry of Interior’s list before applying for another nationality or renouncing Pakistani citizenship.
  • European Union: Many EU states permit dual citizenship, but some (e.g. Germany, Austria, the Netherlands) restrict it unless exceptions apply (e.g. EU/EEA nationality retention or special authorisation).

Legate Hub verifies each country’s requirements before you take any step that may affect your citizenship status.

Acquiring a Second Nationality — Key Considerations

  • Confirm whether your existing country permits dual nationality or requires prior authorisation.
  • Assess the advantages (mobility, residence, property ownership) versus obligations (tax reporting, civic duties).
  • Consider international travel implications and visa-free access under each passport.
  • Review inheritance and succession law conflicts that may arise with multiple domiciles.

Renunciation of British Citizenship — Procedure & Requirements

  1. Complete the Form RN (Renunciation of British Citizenship) — downloadable sample below.
  2. Provide evidence of British nationality (passport, naturalisation certificate, or registration document).
  3. Provide proof of the other nationality or confirmation that acquisition is imminent (to prevent statelessness).
  4. Submit identity evidence (birth certificate or national ID) and any change-of-name documentation.
  5. Pay the Home Office fee and submit the application online or by post with certified copies of all documents.
  6. On approval, the Home Office issues a Renunciation Certificate, which formally ends your British citizenship.

Important: Renunciation is legally irreversible except in rare, limited circumstances. After renunciation, you lose the right of abode, British passport eligibility, and consular protection.

Tax & Financial Implications

  • Tax Residency: Dual nationals may remain UK-tax resident based on time spent in the UK (Statutory Residence Test). Legate Hub coordinates with tax advisers to clarify your obligations.
  • Inheritance Tax: UK inheritance tax applies to worldwide assets for UK-domiciled individuals, regardless of nationality. Changing citizenship does not automatically alter domicile.
  • Capital Gains & Property: Exiting or re-entering the UK may trigger reporting obligations or capital gains events on UK property.
  • Foreign Account Reporting: Dual nationals may be subject to disclosure obligations under FATCA, CRS or similar frameworks depending on jurisdictions involved.

Legate Hub recommends integrated immigration-tax planning before renouncing or acquiring additional nationality.

Required Documents & Checklist

  • British passport or nationality certificate (proof of current citizenship).
  • Evidence of other nationality or proof of imminent acquisition.
  • Form RN – Renunciation Application (signed and dated).
  • Proof of identity (birth certificate, national ID, or current passport).
  • Payment confirmation for Home Office renunciation fee.
  • Certified translations for any non-English documents.
