Skilled Worker Sponsorship Compliance

Maintain Full Compliance Under Your Sponsor Licence

Legate Hub provides dedicated legal and HR support to ensure employers meet all Home Office requirements for Skilled Worker sponsorship.

Overview

Holding a Sponsor Licence brings significant legal responsibilities. The Home Office expects sponsors to monitor sponsored employees, maintain accurate records, and report specific events promptly. Failure to meet these obligations can result in suspension or revocation of your licence. Legate Hub’s compliance service ensures your HR systems, documentation, and reporting standards remain fully aligned with UK Visas and Immigration (UKVI) requirements.

Core Sponsor Duties

  • Record-Keeping: Maintain copies of sponsored workers’ passports, BRPs, contact details, right-to-work documents, and employment records.
  • Monitoring Attendance: Keep daily records of attendance and promptly report unauthorised absences exceeding 10 working days.
  • Reporting Events: Use the Sponsor Management System (SMS) to report key changes within 10 working days, including job title changes, salary adjustments, early terminations, or address changes.
  • Compliance with Immigration Rules: Ensure each sponsored role meets the current skill level and salary threshold under the Skilled Worker route.
  • Cooperation with UKVI: Allow Home Office access to records during announced or unannounced compliance visits.

Mandatory Reporting Requirements

  • Non-attendance, absences or resignation of a sponsored worker.
  • Promotion, change of job title, work location or core duties.
  • Reduction in salary or hours (including unpaid leave over 4 weeks).
  • Company mergers, acquisitions or change of ownership.
  • Changes to key personnel or the Authorising Officer.
  • Errors in Certificates of Sponsorship (CoS) previously issued.

All reports must be made via the Sponsor Management System (SMS) within 10 working days of the event. Legate Hub assists with preparing compliant SMS reports and reviewing documentation before submission.

Home Office Compliance Visits

The Home Office may conduct compliance inspections at any time to assess HR systems, staff awareness and documentary evidence. Legate Hub provides detailed mock audit sessions and document preparation support.

During an Inspection, UKVI May Check:

  • Right-to-work and visa validity evidence for each sponsored employee.
  • Physical attendance records and payroll consistency.
  • Accuracy of job descriptions and SOC codes.
  • Genuine vacancy assessment and recruitment records.
  • Knowledge of sponsor duties among HR staff.

Following an audit, Legate Hub provides a written compliance report highlighting strengths, gaps, and immediate corrective recommendations.
